According to the Attestation Regulations of 1973, attestation is carried out periodically, once every 3 to 5 years. The specific frequency should be determined in the local Regulations on personnel certification.
When establishing the frequency of certification, it is recommended to determine the start date for this period from the moment the head of the order (instruction) issues certification or from the date specified in the order (instruction).
Then you should determine the period that is allotted for certification before establishing the results (from the beginning). This period is set by each organization independently, based on the number of staff, the composition of the certification commission and the number of these commissions, the qualification composition of the certified and other factors.
At the same time, it should be assumed that only the HR inspector is allocated 0.76 people per hour for each employee for designing moments (scheduling, collecting material, filling out certification sheets, minutes of the commission meeting, up to drawing up a report on the results of certification) . This time does not take into account the work of the attestation commission, i.e. actual certification.
The optimal period is 3-6 months, during which certification should be carried out. However, these terms can vary significantly at enterprises (organizations) depending on the number of employees subject to regular certification and the number of existing certification commissions. So, at enterprises (in organizations) with up to 50 certified employees, this work can be carried out in less than 3 months. At the same time, at enterprises (in organizations) with a significantly larger number of managers and specialists, even if there are several attestation commissions 6, the period for attestation will be very tight, so it is advisable to provide for its increase, for example, up to a year.
If at an enterprise (in an organization), with a large number of employees subject to certification, it cannot be carried out within one year, it should be provided for the distribution of the total number of those certified by years within the established frequency. At the same time, it is necessary to comply with the requirement of mandatory summarizing the results of certification and making appropriate decisions both after the completion of the certification of a predetermined number of employees or at the end of the next year, and at the end of the entire certification period.
In the event that it is difficult to determine the timing of the certification in the local Regulations on personnel certification, for example, due to the fact that the staff and its composition are constantly changing, then they can be determined in the order (instruction) on the certification. The possibility of establishing the timing of certification by order (instruction) should be recorded in the local Regulations on personnel certification.
Certification schedules are drawn up by the personnel department together with the heads of structural divisions of the enterprise (organization) based on the total number of employees included in the next certification, the timing of the certification, also taking into account the time required for certification of one person.
Given the need for a comprehensive and complete discussion of the activities of those being certified, the preparation of objective and specific recommendations based on the results of certification, the possibility of fruitful work of members of the certification commissions, it is advisable to conduct certification of no more than 6 - 8 people at one meeting.
It is recommended to indicate in the certification schedule:
- the name of the department in which the certified person works;
- surname, name, patronymic of the certified person;
- the position of the certified person;
- date of certification;
- the date of submission of the necessary documents to the attestation commission;
- position, surname, name, patronymic of the employees responsible for the preparation of documents.

When drawing up the schedule for the certification, it should first provide for the certification of employees of the departments of the enterprise (organization), and then their leaders. This contributes to a more complete analysis of the activities of departments as a whole, a comprehensive and objective assessment of the results of the work of both the leader and his subordinate performers, and the determination of ways to improve their work.
Members of the attestation commissions are attested for common grounds. Their certification is provided for in the certification schedules together with the employees of those departments, the heads or specialists of which they are.
In addition, the certification schedules include employees who were assigned a re-certification a year after passing the next certification (i.e., employees recognized by the results of the certification as corresponding to their positions, provided that they follow the recommendations of the certification commission), as well as employees who which expired the period of exemption from the next attestation.
In the certification schedules, it is advisable to take into account the time reserves for the certification of employees who were absent for good reasons (business trips, performance of state or public duties, illness, etc.) at the enterprise (in the organization) on the days when their next certification was scheduled. However, such amendments to the certification schedules should not lead to violations of the general certification deadlines established by the order of the head of the enterprise (organization).

Many employers perceive the certification of employees as something formal. It is understandable: the Labor Code does not contain clear instructions on the procedure and terms for its implementation. Yes, and regulations in this area, designed to commercial organizations, has not been published recently (attestation is mandatory only for employees of organizations in certain areas of activity): the legislation basically regulates the procedure for attestation of employees public sector. Meanwhile, the results of the appraisal can serve as a basis for dismissal of an employee, therefore we recommend that you take the appraisal itself with all responsibility, since labor disputes are not uncommon and in most cases judges take the side of the employee. Certification: how much in this word ...

We will not find the definition of certification in the Labor Code, but if we turn to dictionaries, we can say that certification is an assessment business qualities and qualifications of the employee in order to establish his compliance with the position held.

Validation results help optimize usage labor resources, to create additional incentives for the professional growth of employees, to form personnel reserve of the most competent specialists, as well as dismiss employees whose qualifications do not meet the requirements for their positions.

Considering the concept of attestation, one cannot ignore the definition of an employee's qualifications, which gives Part 1 of Art. 195.1 of the Labor Code of the Russian Federation: this is the level of knowledge, skills, professional skills and work experience of the employee. Qualification characteristic, necessary for the employee to perform a certain kind professional activity, is determined by the professional standard (part 2 of article 195.1 of the Labor Code of the Russian Federation). Enough has already been developed a large number of such standards. They operate along with qualification guides (EKS and ETKS): the obligation to apply the standards has not yet been established.

However, from July 1, 2016 Art. 195.3 of the Labor Code of the Russian Federation, according to part 1 of which all employers will be required to comply with professional standards, for whose employees laws or regulations legal acts special requirements are set. These are medical and pedagogical workers, auditors, workers contract service etc., that is, those to whom federal laws impose qualification requirements (in particular, to their education).

On the basis of part 2 of this article, the characteristics of qualifications, which are contained in professional standards and the mandatory application of which has not been established, will be used by employers as the basis for determining the requirements for the qualifications of employees, taking into account the characteristics of the labor functions performed by employees, due to the technologies used and the adopted organization of production and labor.

Thus, at present, employers use both qualification reference books and professional standards.

Is employee appraisal mandatory?

Certification may be provided for by legislative acts and be mandatory. For example, certification is usually carried out in budget institutions in relation to state and municipal employees ( teaching staff, art workers, medical workers etc.). But for commercial organizations, so to speak, private companies, certification is optional, unless the company carries out the type of activity where the mandatory certification is established by law. For example, if an organization or individual entrepreneur performs (renders) auxiliary work (services) in the course of transportation by rail, certification of their employees is obligatory (Article 13 of Federal Law No. 17-FZ dated 10.01. railway transport in Russian Federation"). And by virtue of Art. 9 of the Federal Law of July 21, 1997 No. 116-FZ “On industrial safety dangerous production facilities» an organization operating hazardous production facilities (facilities where flammable, oxidizing, combustible substances are obtained, used, processed, formed, stored, transported and destroyed) must ensure the training and certification of employees.

We develop a local act

Part 2 of Art. 81 of the Labor Code of the Russian Federation provides that the procedure for certification is established labor law and other regulatory legal acts, local regulations adopted taking into account the opinion of the representative body of employees.

Accordingly, if the management has decided on the need for certification of employees in the company, it is necessary to develop a local regulatory act regulating the procedure for its implementation.

Before proceeding with the development of such a local act, it is necessary to analyze the positions and work existing in the company for the mandatory certification, and if any are identified, then the provisions of the regulations governing the certification procedure for them must be taken into account. If the company does not have such positions and jobs, the employer is free to establish the certification procedure. However, we still recommend that you navigate:

  • to the Decree of the State Committee for Science and Technology of the USSR No. 470, the State Committee for Labor of the USSR No. 267 dated 05.10.1973 “On Approval of the Regulations on the Procedure for Certification of Managerial, Engineering and Technical Workers and Other Specialists of Enterprises and Organizations of Industry, Construction, Agriculture, transport and communications” (hereinafter - Resolution No. 470/267);
  • on the Regulations on the procedure for certification of executive, scientific, engineering and technical workers and specialists of research institutions, design, technological, design, survey and other organizations of science, approved by the Decree State Committee for Science and Technology of the USSR No. 38, Gosstroy of the USSR No. 20, State Committee for Labor of the USSR No. 50 dated 02/17/1986.
It should be noted that the courts quite often refer to the named regulations when considering disputes on the reinstatement of employees dismissed following the results of certification. For example, in the Ruling of the Moscow City Court dated September 10, 2015 No. 4g / 8-7875 / 2015, the panel of judges concluded that the provision on attestation of an LLC worsens the position of employees compared to Resolution No. 470/267 and cannot be applied. Since the plaintiff, in accordance with the named provision, is classified as a person not subject to certification, the certification carried out by the employer in relation to her is illegal, in connection with which the dismissal under paragraph 3 of part 1 of Art. 81 of the Labor Code of the Russian Federation.

Composition and powers of the attestation commissionThis section defines the composition of the attestation commission with the distribution of functions of its members. As a rule, the commission includes the chairman, members of the commission (including the deputy chairman), the secretary, and also the representative of the trade union (if any) (part 3 of article 82 of the Labor Code of the Russian Federation). Of course, there may be other sections in the local act that are necessary for specific organization. Additionally, usually in an appendix, forms of documents are introduced (for example, minutes of a commission meeting, an attestation sheet, etc.).

After agreeing on all sections of the regulation on the certification, it is approved by the head of the organization: either by issuing an order, or by stamping “Approved” signed by the head. Note that if the regulation is approved by an unauthorized person, then the results of the certification, even if carried out in accordance with the rules established in the organization, will be declared illegal (see, for example, the Appeal ruling of the Court of Chukotka autonomous region dated October 27, 2014 in case No. 33-173/14, 2-25/14).

Remember, the approved regulation on the certification of employees should be read under the signature. In the event of a labor dispute, the employer is obliged to provide evidence that the employee was informed about the possibility of assessing the results of his work and his personal business qualities in the form of certification and that the employee may be dismissed based on the results of the certification.

Certification procedure

Having approved the regulation on the certification, you should not think that the work is over: it is not enough to write everything down on paper, you still need to organize the certification and conduct it. Usually certification is divided into several stages:
  1. preparation for certification;
  2. certification;
  3. Summing up and taking measures based on the results of certification.

At the same stage, a schedule for the certification of employees is being developed. It is necessary to indicate in it not only the full name of the employees and the names of the positions they hold, but also the date, time and place of the certification, as well as provide a list of documents required for submission to the certification commission. In addition, be sure to provide a column in the schedule for familiarizing the employee, where he will put his signature. If an employee refuses to get acquainted with the certification schedule, it is necessary to make an appropriate mark in the schedule and draw up an act confirming this.

The person responsible for the preparation for the commission of documents on certified workers, for preparatory stage draws up and collects the documents necessary for certification: reviews, characteristics, questionnaires, reports, etc.

Next stage - certification. The procedure itself takes place in a designated place. Certification must be carried out in the presence of the certified employee and his immediate supervisor. If an employee fails to attend a meeting of the attestation commission without good reason or refuses to undergo an attestation, the commission may conduct an attestation in his absence.

Note

Carrying out attestation without an employee is allowed only if the employee is familiarized in writing with the date of the attestation. In this case, the employer has the right to bring the employee to disciplinary liability.

During the meeting, the commission hears the immediate supervisor of the person being certified (he briefly evaluates his professional, business and personal qualities), reviews the submitted documents, asks questions to identify the level of professional knowledge, conducts a written test of the level of professional training and knowledge of each employee being certified.

Note that it is important to correctly compose written assignments or ask oral questions. For example, in the Appellate Ruling of the Krasnoyarsk Regional Court dated December 24, 2014 in case No.  33-12241, an employee dismissed for inadequacy of his position due to insufficient qualifications, confirmed by the results of the certification, was reinstated because the defendant violated the certification procedure: the questions indicated in the certification sheet, do not meet the requirements of the job description, there are no answers from the plaintiff to the questions of members of the commission.

Note

The assessment of an employee is based on his compliance qualification requirements according to the position, set out in his job description, employment contract. In this case, the professional knowledge of the employee, work experience, advanced training, retraining and other objective data should be taken into account.

The certification results are recorded in the certification sheet (its form is usually approved by the local normative act), which is signed by the chairman, deputy chairman, secretary and members of the attestation commission who are present at the meeting and take part in the voting. The certified employee must be familiar with the certification sheet for signature.

Certification is accompanied by the maintenance of a protocol in which all information is entered, including the assessment of the employee's qualifications. Then the members of the commission hold a discussion and make a decision on each certified person in the manner prescribed by the regulation on certification (open or closed voting, in the presence or absence of an employee, etc.). The decision of the commission is fixed in the protocol and brought to the attention of employees under the signature in deadlines. After the certification procedure is completed, the relevant information is entered into the employee's personal card.

The final stage certification is the adoption by the employer of a decision, which is drawn up by order. Based on the results of the attestation, some of the attested may be encouraged or offered to be transferred to a higher position, and someone will probably be fired.

With such an order (on the results of certification) it is necessary to familiarize all interested employees.

Summarize

As you understand, personnel certification is a rather complicated and multi-stage process. Therefore, the employer needs to seriously approach the creation of its own provision on the certification of employees and take into account all the nuances of the features labor relations organization and legislation. In addition to such a local act, in any organization that decides to conduct certification of employees, there must be an order for certification, a certification schedule, an order for approval of the certification commission and a regulation on its work, minutes of the commission meeting, documentation on the examination of various employee qualities, as well as other documents, information about which and the forms of which may be contained in the regulation on certification. If everything is done correctly, it will be difficult for the employee to challenge the inadequacy of the position held.

Introduced federal law dated 02.05.2015 No. 122-FZ “On Amendments to the Labor Code of the Russian Federation and Articles 11 and 73 of the Federal Law “On Education in the Russian Federation”.

Since 2020, there have been some changes in the established procedure for certification of pedagogical workers. The attestation procedure itself takes place in order to control the compliance of educators with their positions. The professional activity of the certified person is subject to assessment. There were discussions among industry professionals about the coming changes. In particular, at the end of last year, their comments and suggestions, expert opinions presented by the pedagogical community of the Novosibirsk region. They were considered and taken into account, which indicates the openness of the process and the sincere desire of the direct participants to improve the declining level of education in the country.

2 stages of certification

The law provides for the organization of such inspections every 5 years. In cases where the teacher ignores the check or cannot confirm the already existing category, then the one available for 5 recent years qualification is cancelled. The new procedure for certification of teaching staff involves 2 stages:

  • At the 1st stage, the teacher proves his professional suitability. Here, pedagogical skills are tested, the ability to teach, get along with children is considered. The innovation was computer testing. The developed tests include 100 questions, the allotted time is 2.5 hours. The questions cover a wide range of topics - from knowledge of the subject to the basics of Russian legislation. Each question has only 1 correct answer out of 6 offered. Correct answers to at least 60% of the questions guarantee the applicant confirmation of the existing qualification.
  • For participants who have overcome 85% or more of the questions and have 1 category, the next stage begins. At the 2nd stage, the teacher category is obtained. The first and highest categories are assigned at this stage. But to get the 1st one, you need to have the 2nd one, and to get the highest category, you need the 1st one for at least 2 years. To test for the highest category, a self-examination report is required. The report consists of publications, electronic and paper, methodological developments. Well, if they are already being put into practice. Further, lists of students who participated, or better, who won in olympiads, competitions, and other competitions, are provided. Great weight will be given to the report by evidence of personal achievements, namely, awards, certificates of honor, letters of commendation. That is, the general human level of the applicant of the highest category of professionalism should be noticeably above average. For the 1st category, everything is easier. Here you need to have a 2nd category, go through the 1st stage, show ownership modern methods. But in both cases, it is recommended to have a portfolio and video materials.

An increase in the category occurs with the obvious success of students in mastering curriculum, scientific, intellectual and creative activity. At the same time, the contribution of the teacher to the development and correction of the learning process is taken into account. Participation in special, thematically and professionally oriented events, which are also held in the format of public discussion.

Changes in attestation were made, among other things, to stimulate the improvement of the level of the country's teaching staff. To be able to increase the requirements for the teacher, it is necessary to determine the level of skill that is available at the moment. Then improve the quality of teaching at all levels of education. And besides this, professionalism checks allow you to distribute wages in accordance with the existing qualifications, which will not allow equalization between employees.

Types of attestation

In Russia, the rules prescribe 2 types of certification: mandatory and voluntary. The first concerns all working teachers and serves the already established level of education. But people who care about their professional growth, and growth, are interested in voluntary certification wages. Prior to this, teachers wrote applications for qualifications to the district departments of education in order to increase their earnings. According to the new rules, the organization of this procedure is occupied educational bodies subjects of the Russian Federation.

Certification of teaching staff in 2020 begins with the process of organizing an event. To do this, the head of the educational institution submits a presentation for the employee to the certification commission and no later than 30 days before the event, must familiarize the teacher with it. If certification is voluntary, then its organization begins with a statement from the teacher with a request to be certified to the head of the educational institution. For certification of teaching staff in 2020, in addition to the signed application, copies of the following documents will be required:

  • extract from the protocol of the last inspection;
  • diploma of vocational education;
  • confirmation of the existence of categories, if any;
  • documents on the change of surname, if such a fact takes place;
  • job description.

Attestation procedure

Lack of additional professional education is not a reason for rejecting an application for a qualification category. The organization of the attestation process should ensure openness and collegial decision-making. Such forms of certification of teaching staff provide an objective, non-discriminatory assessment of the professional suitability of colleagues. The decision to improve the qualifications of a teacher is made by a specially convened commission, whose members evaluate the competence and vocation to teach the younger generation. The meeting of the commission takes place in the presence of certified citizens. But even if the person responsible for the meeting does not appear on good reason, then the decision on the compliance of his presence at the workplace will be made without him. The protocol is conducted according to locally established rules. There is no single form. All members of the commission sign this protocol. An extract from the protocol, which replaced the certification sheet, with the results of the check and the personal data of the employee, is ready in a couple of days. Within the next 3 days, the employee must be familiarized with the extract against signature and put it in his personal file. If everything went well, the teacher is certified, then an order is issued on the appropriate qualification, on the basis of which an entry is made work book.

Mandatory certification of education workers does not affect:

  • pregnant and on maternity leave, teachers. For them, the certification period is postponed for 2 years from the date of entry to work;
  • pedagogical workers with a qualification category;
  • young teachers with less than 2 years of teaching experience;
  • teachers who are on sick leave more than 4 months. They will have to be certified one year after the closure of the sick leave.

But voluntary certification is not prohibited in any case. The result of a voluntary audit may be the 1st or the highest qualification category, established for a 5-year period, but not subject to renewal.

Important! The highest qualification category is assigned only after passing qualifying exams. But before passing the exams for the highest category, it is necessary to develop an author's teaching methodology in an educational institution and publish it in specialized publications.

One of the rules on the certification procedure for teaching staff states that the highest qualification category is the crown of teaching excellence. It can no longer be raised further, but it needs to be confirmed.

Representatives of the Ministry of Education made a proposal to the Government of Russia to make even greater changes in the procedure for attesting teachers. Namely, to conduct a stage of testing knowledge of IT technologies and communication, to improve the skills of getting out of conflict situations not only with students, but also with their parents. School Attestation Procedure

Certification of pedagogical workers of a municipal school or a school under the jurisdiction of a constituent entity of the Russian Federation takes place in an attestation commission under the executive authority of a constituent entity of the Russian Federation. Certification of a pedagogical worker (except for scientific and pedagogical workers of universities) of a federal state educational institution is carried out attestation commission formed by the federal executive authorities in whose jurisdiction it is located. For personal participation in the meeting of the attestation commission, the employer sends the teacher on a business trip.

The attestation procedure, approved by the Order of the Ministry of Education and Science of Russia, applies to all municipal and state educational organizations that are under the jurisdiction of executive authorities.

Certification of teaching staff of non-state educational organizations, as well as organizations that do not carry out educational activities, is not regulated by this document and requires a separate legal justification. It is known from practice that pedagogical workers of non-state educational and other organizations apply to the attestation commission of the constituent entity of the Russian Federation in whose territory their organization is located. For this category of workers, certification can be carried out on a paid basis.

Forms of attestation

Certification of teachers of municipal and state educational institutions takes place in two forms.

Mandatory attestation is carried out every five years to confirm the teacher's compliance with the position held on the basis of an assessment of his professional activity; such certification, as a rule, is carried out for those who do not have a qualification category. A teacher cannot refuse to participate in such certification, since it is a labor obligation for him.

Voluntary certification is carried out at the request of the teacher to establish the level of his qualifications to the requirements of the first (or highest) qualification category. The qualification category is valid for five years. If there is a qualification category during the entire period of its validity, the teacher may not undergo mandatory certification.

Mandatory certification

The basis for the mandatory certification of a teacher is the presentation of the head of the school to the certification commission.

The submission must contain a motivated comprehensive and objective assessment of the professional, business qualities of the employee. the results of his professional activity on the basis of the qualification characteristics for the position held; information about the passage of advanced training by the teacher, including in the direction of the school, for the period preceding the certification; information about the results of previous certifications.

The qualification characteristics for the positions of pedagogical workers are determined by the Order of the Ministry of Health and Social Development of the Russian Federation n “On Approval of the Unified Qualification Handbook for the Positions of Managers, Specialists and Employees, Section “Qualification Characteristics of the Positions of Educational Workers”6. It is essential in these characteristics that the majority of teachers have a secondary (or higher) professional education in the direction of training "Education and Pedagogy". In some cases, a special defectological or psychological education is required, professional mastery of the technique of playing a musical instrument, or only higher professional education without specifying the training profile, or education in the field of physical culture and sports.


Only in exceptional cases can pedagogical positions be occupied by persons who do not have special training or length of service, established in the "Qualification Requirements" section of the qualification characteristics, but having sufficient practical experience and competence, performing qualitatively and in full the duties assigned to them. This is possible only on the recommendation of the certification committee. Because of this, the certification of teachers who do not have a pedagogical or other special education is of fundamental importance for teachers who continue to work in schools.

The structure of the representation of the head of the school can be as follows:

professional and business qualities of the teacher;

passing by the teacher of advanced training;

information about the results of previous teacher certifications;

working conditions of the teacher and their compliance with modern requirements:

the effectiveness of the methodological activity of the teacher.

After the teacher gets to know performance the head of the school, he has the right (if he does not agree with this document) to send his own information characterizing his labor activity for the period from the date of the previous certification (in case of primary certification - from the date of employment), as well as an application with the appropriate justification.

During certification, a pedagogical worker passes qualification tests in writing on issues related to his pedagogical activity. The content and types of such tests are determined by the certification committee: it can be electronic testing in the mode on-line , solving situational tasks to test knowledge of regulatory legal documents or completing tasks on control and measuring materials for a subject in the USE format.

Electronic testing in mode on-line it is more preferable for certification of teachers, given that most Russian schools have access to the Internet, and this procedure does not require the cost of transporting teachers to certification centers.

Based on the results of the mandatory certification, the certification commission makes one of the following decisions:

Employee - corresponds to the position held;

Employee - does not correspond to the position being hired.

For teachers in this case, the subject they teach is not indicated.

If the teacher is recognized as appropriate for the position held, in his Personal Card (form No. T-2), approved by the Decree of the State Statistics Committee of Russia, in section IV "Attestation", it is necessary to indicate the result of the attestation.

The record is drawn up as follows: the date of certification, the decision of the commission: "Corresponds to the position of the teacher of physics", the protocol number, the date of the protocol, the reason: "the date and number of the order."

If the teacher, according to the results of certification, is recognized as not corresponding to the position held due to insufficient qualifications, the employment contract with him may be terminated in accordance with paragraph 3 of part 1 of article 81 Labor Code(TC) RF. Dismissal on this basis is allowed if it is impossible to transfer the teacher from his written consent for other work available at the school that he can perform taking into account his healthy condition (part 3 of article 81 of the Labor Code of the Russian Federation).

In the work book in case of dismissal, the grounds for dismissal should be recorded: “ Labor contract terminated due to the inconsistency of the employee with the position held due to insufficient qualifications, confirmed by the results of certification (paragraph 3 of part one of Article 81 of the Labor Code of the Russian Federation).

However, the employer must remember that layoffs in this situation are his right, not his obligation. If the employer is interested in this employee he can send the teacher to advanced training courses and after some time, necessary to establish the indicators of his work, re-submit the teacher for certification.

Even with negative certification results, the dismissal of a teacher during certain periods of labor relations is not allowed. Such periods include the period of temporary disability of the employee and the period of his stay on vacation. Dismissal is not allowed for pregnant women, as well as women with children under the age of three, single mothers raising a child under the age of fourteen (a disabled child - up to eighteen years), other persons raising these children without a mother (Article 261 of the Labor Code of the Russian Federation). The dismissal of a teacher - a member of a trade union is allowed subject to the procedure for taking into account the motivated opinion of the elected body (trade union bureau) of the primary trade union organization in accordance with Article 373 of the Labor Code of the Russian Federation (part two of Article 82 of the Labor Code of the Russian Federation).

The employee has the right to appeal the results of the assessment, including dismissal based on the results of the assessment, in court.

Mandatory certification is not subject to:

Teachers who have worked in this position for less than two years (young specialists; persons who have come to work in this position for the first time);

Pregnant women; women on maternity leave; teachers who are on parental leave until the child reaches the age of three years. Mandatory attestation of these employees is possible not earlier than two years after their release from such holidays.

The procedure for attesting a teacher to confirm his/her compliance with the position held applies primarily to teachers who have never passed certification, who did not pass it on time, and those who did not confirm their qualification category during certification.

Voluntary certification

Certification of a pedagogical worker to establish the level of qualification with the assignment of a qualification category to him (voluntary - certification) conducted on the basis of a personal statement of the teacher. The application of a teacher for attestation must be considered by the attestation commission no later than one month from the date of submission.

According to the results of certification, the teacher can be assigned the first or highest qualification category. The attestation procedure approved by the Order of the Ministry of Education and Science of Russia does not provide for the establishment by the executive authority in charge of education of other qualification categories, levels and ranks, except for the first and highest qualification categories.

Voluntary certification in the form of conducting for the first and highest qualification categories may be the same, but their content must be different.

In some attestation commissions, teacher certification to establish the first qualification category is carried out on the basis of a survey, for example, a teacher's portfolio, a pedagogical performance map and an analysis of video lessons (video lessons) or multimedia presentations. There are usually two sections in the teacher's performance map. The first of them indicates the degree of activity and initiative of the teacher in methodological, organizational and social-pedagogical activities. The second section is devoted to evaluating the effectiveness of the teacher's pedagogical activity. A teacher's performance map can be presented in a teacher's portfolio.

This form of attestation can be based on the selection criteria formulated for the competition "The Best Teachers of Russia" (Order of the Ministry of Education and Science of the Russian Federation dated March 26, 2010 No. 000):

High results of educational achievements of students with their positive dynamics over the past three years;

High results of extracurricular activities of students in the subject;

Creation by the teacher of conditions for the acquisition of positive social experience by students;

Security High Quality organization of the educational process based on effective use modern educational technologies, including information;

The presence of a teacher's own methodological system, tested in the professional community;

Continuity professional development teachers.

View video tutorials or multimedia development training session allows the attestation commission to assess the degree of the teacher's mastery of modern educational technologies and methods, the effectiveness of their use in the classroom.

If a teacher wishes to pass certification for the highest qualification category ahead of schedule, he/she applies to the certification commission with an application for certification to establish the compliance of the level of his qualification with the requirements for the highest qualification category, not earlier than two years after the establishment of the first qualification category for him.

When attesting for the highest qualification category, a teacher can present a teacher's portfolio and a map of innovative pedagogical experience and project development to the attestation commission. In the map of innovative pedagogical experience, the teacher generalizes his experience of innovative activity.

b) the level of qualification of the employee does not meet the requirements for the first (highest) qualification category.

Makes a personal contribution to improving the quality of education through the improvement of teaching and upbringing methods;

Has stable results of development by students, pupils educational programs and indicators of the dynamics of their achievements

above average in the subject of the Russian Federation.

Have the established first qualification category;

Possess modern educational technologies and methods and effectively apply them in practical professional activities;

They have stable results in the development of educational programs by students, pupils and indicators of the dynamics of their achievements above the average in the subject of the Russian Federation, including taking into account the results of the participation of students and pupils in All-Russian, international Olympiads, competitions, competitions;

Make a personal contribution to improving the quality of education through the improvement of teaching and upbringing methods, innovation activities, in the development of new educational technologies and actively disseminate own experience in the field of improving the quality of education and upbringing.

Note that this procedure sets a very high bar for the participation of pupils and students in various olympiads, contests and competitions. The level of such participation, according to the procedure for awarding the highest qualification category, is not lower than the All-Russian one. Such an indicator will significantly affect the assignment of this qualification category to teachers: there will be much fewer teachers with this category, but they will indeed be recognized masters of their craft.

When making a decision of the attestation commission on the non-compliance of the teacher's qualifications with the requirements for the highest qualification category, he retains the first qualification category until the expiration of its validity.

The qualification category of a teacher established on the basis of voluntary attestation is valid for five years. Qualification categories are retained when an employee transfers to another educational institution, including one located in another subject of the Russian Federation, during the period of its validity to the same position.

The result of such certification may be the admission of teachers with the first qualification category to work in gymnasium, lyceum, specialized classes, work with talented children. A teacher with the first qualification category can play the role of a mentor, developer, experimenter, researcher in an educational organization.

A teacher with the highest qualification category may also head a methodological association, be the head of a school department (a structural subdivision of an educational institution), lead research projects, be an expert in assessing the achievements of colleagues .

Rights

Regulations on certification and others regulations on issues of attestation of pedagogical workers, they grant rights to the certified teacher. So, during the certification period, the teacher has the right:

Pass certification at least once every five years;

Submit an application for certification for the highest qualification category before the expiration of the first qualification category;

To be notified about the schedule for passing individual certification;

Choose a specific form and certification procedure from the variable forms and procedures;

Submit any documented results confirming the competence and efficiency of the work being certified;

Be present when the decision of the attestation commission is made and be acquainted with the results of attestation immediately after the voting of the members of the commission;

Familiarize yourself with an extract from the order of the executive authority in charge of education, culture, healthcare and other areas economic activity under which an attestation commission was created, on assigning a qualification category to an employee or confirming compliance with the position held;

Complain about the certification procedure in the commission for labor disputes, court in the manner prescribed by the labor legislation of the Russian Federation.

The attestation procedure defines several time steps for performing procedural actions, which all participants in the attestation are required to comply with. For example, the new attestation procedure establishes the following procedural deadlines:

Familiarization of the employee with the text of the presentation of the head of the organization - one month before the start of certification;

Written notification of the employee about the date, place and time of the mandatory certification - one month before the start of the certification;

Submission by an employee of an application for certification to establish the compliance of their qualification level with the requirements for the highest qualification category - two years after the establishment of the first qualification category;

Consideration of the employee's application for certification - within one month from the date of submission;

Attestation for compliance with the position held - every five years;

The term for certification for the qualification category is set for each certified individual individually in accordance with the certification schedule;

The duration of certification from the beginning of its passage to the adoption of a decision is no more than two months;

Adoption of a decision by the attestation commission and familiarization of the attested employee with it - on the day of the commission's meeting;

Issuance of an order on the assignment of a qualification category - within one month from the date of the commission's meeting;

Validity of the qualification category of an employee - five years;

Validity of the qualification category when a teacher transfers to another educational institution, including one located in another constituent entity of the Russian Federation, - during the period of its validity; exemption from attestation for compliance with the position held for certain categories of employees - two years;

Appeal to the commission on labor disputes or to the court regarding the procedure for attesting an employee (in accordance with Articles 386, 392 of the Labor Code of the Russian Federation) - within three months from the date when the employee found out or should have found out about the violation of his rights;

Appeal to the court on disputes about dismissal based on the results of certification - within one month from the date of delivery to the employee of a copy of the dismissal order or from the date of issuance of the work book.

When evaluating the activities of a teacher over the time that has passed since the last certification, the certification commission should proceed from the fact that the certification of an employee is not so much an assessment of his work as building a trajectory for the teacher's professional growth for the period until the next certification. Therefore, during certification, it is important to determine the ways for further growth of his professionalism, professional competence.

The certification of teachers is focused on the model of a specialist who is able to qualitatively implement the main functions of professional activity (formative, diagnostic, prognostic, research, analytical).

Paperwork

An important procedural moment in the certification of teachers is the execution of final certification documents. The decision of the attestation commission is reflected in the minutes of the meeting of the attestation commission, the attestation sheet of the person being attested, in the order of the executive authority in charge of education, culture, healthcare and other areas of economic activity, under which the attestation commission was created, as well as in the work book of the employee who passed the attestation .

For example, in the work book of a teacher (section "Information about work") about the qualifications assigned, the following entries are made:

In column 1 - the serial number of the entry being made;

In column 2 - the date of the decision of the attestation commission;

In column 3 - “The first (highest) qualification category was assigned for the position of“ teacher ”(without indicating the subject taught);

In column 4 - the date and number of the order of the executive authority, on the basis of which the entry was made.

Recall that in accordance with Article 85 of the Labor Code of the Russian Federation, the personal data of an employee includes information necessary for the employer in connection with labor relations and relating to a particular employee.

An attestation sheet and an extract from the administrative act of the federal executive body, the executive body exercising control in the field of education, culture, health care and other areas of economic activity, under which an attestation commission of the executive power was created, stored in the personal file of a pedagogical worker, as well as attestation materials , which are in the attestation commissions, relate to the personal data of a pedagogical worker and are subject to protection in the manner determined by the Federal Law of 01.01.2001 "On Personal Data" and Chapter 14 "Protection of Personal Data of an Employee" of the Labor Code of the Russian Federation.

Thus, the certification of teaching staff should be considered as a comprehensive, continuous process of assessing their activities, organizational, scientific, methodological and financial support which is assumed by the executive authority of the constituent entity of the Russian Federation.

Case Studies

The term of the qualification category ends for the teacher, and he does not want to pass the certification. Is it necessary to pass certification if he does not want to?

The teacher of chemistry also works as a "teacher of biology". How can he pass certification, for one position or for two?

The pedagogical worker undergoes certification for the position of "teacher", and not for the discipline taught. In his application, he indicates the name of the position in which he wishes to undergo certification, and the qualification category assigned as a result of certification applies to both teacher positions.

The teacher passed the mandatory certification. Can he immediately qualify for the highest category?

Is the lack of experience in a pedagogical specialty grounds for refusing certification for the first category?

The pedagogical worker does not agree with the results of the attestation specified in the decision of the attestation commission. Where can he complain?

There is no ban on certification for a higher qualification category for part-time teachers. In this situation, the teacher has the right to be certified by any employer both at the main place of work and at a part-time job.

Does the teacher have the right to refuse to undergo certification in order to establish compliance with the position held (mandatory certification)?

An employee's refusal to undergo mandatory certification is a violation labor discipline. In accordance with Article 21 of the Labor Code of the Russian Federation, compliance with labor discipline is the duty of the employee. 7.Certification procedure

The document details the procedure for attesting teachers for compliance with the position they hold and assigning them qualification categories. It has been established that:

a) In accordance with the Procedure, certification of teachers in order to confirm their compliance with the positions they hold based on an assessment of their professional activities is carried out attestation commissions, independently formed educational organizations , in accordance with the directive of the employer.

The composition of the attestation commission of the organization should include the chairman of the commission, deputy chairman, secretary and members of the commission, as well as Mandatory representative of an elected body the relevant primary trade union organization (if such a body exists).

When making a decision, the attestation commissions of organizations also give recommendations to the employer on the possibility of appointing teachers to the relevant positions. persons who do not have special training or work experience, established in the section "Qualification requirements" of the section "Qualification characteristics of positions of educational workers" of the Unified qualification directory of positions of managers, specialists and employees and (or) professional standards, but having sufficient practical experience and competence, performing qualitatively and in full the duties assigned to them responsibilities .

b) Certification of teaching staff in order to establish a qualification category is carried out:

  • for pedagogical workers of organizations that are under the jurisdiction of federal executive authorities - attestation commissions formed by the federal executive authorities in whose jurisdiction these organizations are located;
  • in relation to pedagogical workers of organizations that are under the jurisdiction of the constituent entity of the Russian Federation, pedagogical workers of municipal and private organizations - attestation commissions formed by authorized bodies state power of the constituent entities of the Russian Federation.

Certification of pedagogical workers is carried out on the basis of their applications submitted directly to the attestation commission, or sent by pedagogical workers to the address of the attestation commission by mail with a letter with a return receipt or with a notification in the form electronic document using public information and telecommunication networks, including the Internet.

It has been established that applications for attestation for the assignment of a qualification category are submitted by educators, regardless of the duration of their work in the organization, including while on parental leave.

Applications for certification in order to establish the highest qualification category for the position for which the certification will be conducted for the first time are submitted by teaching staff not earlier thanin two years after the establishment of the first qualification category for this position.

The expiration of the highest qualification category does not limit the right of a teacher to subsequently apply to the certification commission with an application for certification in order to establish the highest qualification category for the same position.

Teachers who, during certification denied qualification category, apply at their request to the attestation commission with an application for attestation for the same qualification category not earlier than one year from the date of adoption of the relevant decision by the attestation commission.

When teaching staff transfer to another organization, including one located in another subject of the Russian Federation, the qualification categories established by it are retained until their expiration date..

Appealing the results of attestation

The employee has the right to appeal the results of certification in accordance with the legislation of the Russian Federation.
