The list is approved by the Order of the Ministry of Regional Development Russian Federation, but was repeatedly changed, adopted in new edition. The list was approved by order of the Ministry of Regional Development of the Russian Federation dated December 30, 2009 No. 624, and the changes were made by order of the Ministry of Regional Development of the Russian Federation dated June 23, 2010 No. 294.

Document type

At the moment, the SRO certificate is an extract from the register of members of self-regulatory organizations, it is provided in in electronic format. The document issues a partnership in which an individual entrepreneur or legal entity is a member.

The applicant needs to apply for the issuance of this permit in free form on paper with your signature. The document, if necessary, is printed on plain paper, the seal of the SRO and the signature of the head are affixed to it. The excerpt is valid for 1 month from the date of issue.

    Use the search box, fill in the name of the self-regulatory organization, enter the taxpayer identification number, registration number records (SRO number, for example “SRO-S-293-13032018”).

    Click search. A company that is listed in a self-regulatory organization will be found, otherwise your company does not have permission.

What else you should pay attention to when applying for an extract from the SRO

Having on hand SRO admission, pay attention to the following points:

  • field "date": the validity of the statement is not less than a month from the date of issue;
  • column 3: there should be no information that the organization is excluded from the SRO;

    column 4: must contain information on what types of construction work the participant has the right to perform;

    points 5, 6: whether the level of responsibility indicated in the certificate corresponds to the price offered by the contract participant (for participation in state and municipal tenders in accordance with 223-FZ and 44-FZ).

In 2018, the company does not receive a special certificate form on paper with protective layers and a hologram for admission to design, survey, and construction work. Now the organization receives the usual one in which it is a member. The document is issued in electronic or paper form.

SRO is a non-profit self-regulatory organization that unites business or professional activity in one industry or market. In some ways, the SRO is reminiscent of the concept of a guild (from the German Gilde - an association of merchants), which also unites people of the same or similar professions. Another name for a self-regulatory organization is a non-profit partnership.

In Russia, participants in the securities market were first obliged to join self-regulatory organizations back in the mid-1990s. The activities of SROs are regulated by federal law No. 315-F3 dated December 1, 2007 “On Self-Regulatory Organizations”. Membership in such organizations is voluntary, but federal laws there may be cases of mandatory participation in SROs, for example, in construction. Just using the example of SRO for builders, we will try to understand how this structure functions.

When should I join the SRO?

From January 1, 2010, licenses for design, construction and engineering surveys for buildings and structures were terminated, and instead of them, participation in the relevant self-regulatory organization became mandatory if the organization or individual entrepreneur plans to carry out the work specified in List of types of work(approved by the Order of the Ministry of Regional Development of the Russian Federation dated December 30, 2009 No. 624).

If the work you are planning is not listed in the List, then it is not necessary to join the SRO. If there is, but at the same time marked with an asterisk *, then SRO approval is required only if the facility on which these works will be carried out is indicated in Article 48.1 of the Town Planning Code of the Russian Federation.

The list does not apply to the following objects:

  • not requiring the issuance of a building permit in accordance with part 17 of article 51 of the Town Planning Code of the Russian Federation (garages not intended for entrepreneurial activity, kiosks, sheds, buildings and structures for auxiliary use, etc.);
  • for objects of individual housing construction, with no more than three floors.

That is, there is a large amount of construction work for which SRO admission, and hence entry into self-regulatory organization not required. For example, a permit is not needed for finishing and painting work, installing windows, landscaping work, and individual low-rise construction.

At the same time, the customer may require the contractor to be a member of an SRO, and the condition for the admission of a self-regulatory organization may be mandatory for the performance of work under a state order.

What does the SRO do?

The SRO develops standards and rules for the activities of participants in their professional field and monitors their observance. For violation of these rules, members of the self-regulatory organization may be subject to disciplinary measures, such as:

  • instructions obliging a member of a self-regulatory organization to eliminate the identified violations in their activities;
  • issuing a warning;
  • imposition of a fine;
  • exclusion from SRO members.

If necessary, members of self-regulatory organizations bear solidarity liability to third parties for damages at the expense compensation funds and civil liability insurance. Considering that all members of the self-regulatory organization are financially responsible for the dishonesty of one SRO member, it becomes clear that this mechanism works to improve the quality of construction services.

Types of SROs in the construction industry

AT construction industry There are three types of self-regulatory organizations:

  • SRO in construction, for organizations and individual entrepreneurs directly involved in construction;
  • SRO in engineering surveys;
  • SRO in design, for those who develop project documentation.

If an organization or an individual entrepreneur intends to engage in construction, design and survey work, then three separate permits must be obtained for each of these activities.

Self-regulatory organizations are united by type of activity into national structures:

  • National Association of Builders (NOSTROY)
  • National Association of Designers (NOP)
  • National Association of Surveyors (NOIZ)

At the All-Russian Congress NOSTROY in December 2014, the need to combine all these structures into one was discussed, which should benefit all participants in the construction market.

SRO approval

An SRO permit is a permit issued by a self-regulatory organization to its member to carry out the work specified in the List of types of construction work (approved by Order of the Ministry of Regional Development of the Russian Federation of December 30, 2009 No. 624). If a SRO permit is required for construction work, and an organization or an individual entrepreneur operates without it, administrative (a fine of up to 50 thousand rubles) and even criminal liability is provided for this.

The permit is issued for an unlimited period of validity, and it is possible to work on it throughout the territory of Russia. The procedure for granting admission to an SRO depends on the conditions approved by the internal regulations of a particular self-regulatory organization. The requirements for issuing a certificate of admission are approved at a general meeting of members of a self-regulatory organization separately for each type of work, and they depend on the objects at which these works are carried out: unique, especially dangerous, technically complex.

Those wishing to obtain a permit will have to document the presence in the staff of workers with the necessary qualifications and a sufficient technical base. The minimum requirements for personnel is the presence of three specialists with higher education or five with secondary specialized education (with a certain length of service and qualifications). Some SROs may require their members to be ISO certified when joining. Such a certificate confirms that its owner has an organized quality management system, which ensures high quality goods and services.

How to choose an SRO?

The Federal Service for Ecological, Technological and Nuclear Supervision (Rostekhnadzor) maintains a state register of self-regulatory organizations. In addition to the register of the SROs themselves, a list of members of each self-regulatory organization is also provided, which allows the customer to verify the legality of the admission of the SRO of a particular contractor. Be sure to make sure that the self-regulatory organization you have chosen is in this register, the permits issued by SROs that are not in it are invalid.

SRO can be regional or include builders with different areas Russia, and finding a future partner does not matter: legal SRO permits are valid throughout Russia, and the application and further document flow are often carried out electronically. It is better to choose a large, long-running organization with a large number of participants and an impressive compensation fund. Each SRO sets its own requirements and conditions for those who join it, the amounts of fees will also be different: entrance, membership and target. The amount of the contribution of the compensation fund is established by law, therefore it is the same for all SROs.

The state register contains all the information on each self-regulatory organization, indicates the types of work for which it can issue permits, the size of the compensation fund, and contact details. How to join the SRO?

To join the SRO, an organization or an individual entrepreneur must fulfill a number of requirements:

1 .Prepare the necessary package of documents. As an example, here is a list of documents of one of the SROs:

  • application for obtaining a certificate of admission;
  • copies of the Articles of Association, extract from the Unified State Register of Legal Entities, certificate of TIN, protocol on the appointment of the director;
  • information on the number of managers and specialists;
  • copies employment contracts, work books, diplomas, certificates of promotion for executives and specialists with higher or secondary vocational education in the profile of the declared activity;
  • information on the number of workers with qualifications of at least 3 categories;
  • scheme production structure organizations;
  • information about technical means, including those involved on a contractual basis;
  • information about buildings, structures, premises used for the implementation of the declared types of work (including temporary and auxiliary);
  • information on the provision of the declared types of work with normative-technical and technological documentation;
  • information on the types of construction activities performed by the organization at capital construction sites;
  • information about the quality control system for construction and installation works, building materials, structures and products.

Additionally, the SRO may request accounting and tax reporting, local documents on labor protection, information about the construction activities and professional reputation of the candidate, certificates of attestation of their own laboratory or an agreement with such a laboratory, etc.

2 .Pass verification of submitted documents control management SRO. Some self-regulatory organizations are not limited to a desk audit (purely documentary), but arrange an on-site audit to check the real activity of the candidate.

3. Pay fees for participation in the SRO: entrance, membership, target, as well as a contribution to the compensation fund.

4. Get a civil liability insurance policy. This condition is not set by all SROs, but without such a policy, the contribution to the compensation fund will be higher.

5. Obtain a certificate of admission to work.

How much does it cost to join the SRO?

Despite the fact that the SRO is called a non-profit partnership, maintaining its functioning is not cheap. This is a complex structure that unites not only the participants, but also includes the control, audit and disciplinary commissions; executive and collegiate management bodies; arbitration court. The supreme governing body of the SRO is general meeting its members. To finance this activity, the participants of the partnership pay fees upon joining the organization: entrance, membership, target.

The amounts of these contributions are set by the organization itself, here is an example of these amounts of one of the non-profit partnerships:

  • entrance fee - 10,000 rubles;
  • annual membership fee - from 55,000 rubles (with income of an SRO member up to 10 million rubles) to 150,000 rubles (with income of more than 500 million rubles);
  • the target annual fee is 5,000 rubles.

And finally, a contribution to the compensation fund, which is used to compensate for the damage caused by SRO participants to third parties as a result of their professional activities. Minimum size contribution to the compensation fund specified in Art. 55.16 of the Town Planning Code and is:

  • for builders from 300,000 rubles, and in the absence of a civil liability policy from 1 million rubles;
  • for designers and surveyors from 150,000 rubles, and in the absence of a civil liability policy from 500,000 rubles.

Refund of all contributions made upon withdrawal of the participant from the SRO is not made.(Article 55.7 of the Town Planning Code and Article 13 of Law No. 315-F3 of December 1, 2007), except in cases of liquidation of a non-profit partnership.

According to Art. 55.6 (6) of the Town Planning Code, the SRO permit is issued no later than three days after the decision has been made, the entry fee and contribution to the compensation fund have been paid. Some SROs offer various ways of lending to their members, that is, paying installments in installments.

The sensational law No. 359-FZ of November 24, 2014, in fact, does not regulate the issue of “cancellation of installment plans in SROs”, but at the same time it obliges a self-regulatory organization to have a compensation fund in accordance with the number of its members. If, when checking a non-profit partnership, it turns out that the compensation fund is insufficient, then the SRO may be deprived of its status, and all permits issued by it will be invalidated.

Since the abolition of licensing for engineering surveys, design and construction of buildings and structures, the leaders of many construction companies puzzled by the question of the need to join the SRO and the possibility of working without it.

There is a lot of information on this issue, and on the Internet it is often either false or presented in such a way that there are even more questions than specific answers.

Summarizing the available information and relying strictly on current legal norms, we will try to give our comment on this question in an accessible form in such a way that each applicant can answer it independently.

Membership in SRO is NOT needed when it comes to:

1) About customized housing construction, i.e. stand-alone residential buildings, with the number of floors not exceeding three and intended for the residence of no more than two families in each house;

2) On the construction of residential buildings with no more than three floors, consisting of several blocks, the number of which does not exceed ten and each of which is intended for one family. These houses share a common wall(s) without openings with the neighboring block(s). They are located on separate land plots and have access to the common area (residential houses of blocked development);

3) About construction apartment buildings with the number of floors not exceeding three, consisting of one or more block sections, the number of which does not exceed four. In each of the block sections there are several apartments and common areas. Each block section has a separate entrance with access to the common area;

4) About building a garage on land plot granted to an individual for purposes not related to the implementation of entrepreneurial activities, as well as on the construction of a summer cottage on a land plot provided for gardening;

5) On the construction, reconstruction of objects that are not objects of capital construction (kiosks, sheds and others);

6) On the construction of buildings and structures for auxiliary use on the land plot;

7) On changing capital construction objects and (or) their parts, if such changes do not affect the design and other characteristics of their reliability and safety and do not exceed the limiting parameters of permitted construction, reconstruction established by the urban planning regulations;

c) hazardous production facilities where mining operations are carried out (with the exception of the extraction of common minerals and the development of alluvial deposits of minerals carried out by an open method without the use of blasting), mineral processing.

Unique objects include capital construction objects, the project documentation of which provides for at least one of the following characteristics:

1) height more than 100 meters

2) spans over 100 meters

3) the presence of a console more than 20 meters

4) deepening of the underground part (in whole or in part) below the planning level of the earth by more than 15 meters

Summarizing, we come to the conclusion that the list of works, performing which you can not join the SRO is quite extensive. If among this list you did not find those types of activities that you are engaged in, then you definitely need to obtain a certificate of admission to work.

Not all SROs place contributions of their members in accredited banks, as a result of which they are excluded from the self-regulation register, and their members are deprived of the right to conduct activities in the field of construction. According to 372-FZ, the SRO compensation fund, which consists of contributions from members of self-regulation, must be located in one of the accredited banks. According to NOSTROY statistics in 2018, 83 billion rubles ( total amount compensation funds in the Russian Federation) must be placed on the appropriate accounts. Actually placed about 57 billion. In this regard, 30 SROs were excluded from the register, and their members lost both their permits and the money invested in obtaining them.

Since 2017, a new type of SRO permit is required for work

Under the new legislation, paper-based tolerances in the form of certificates are no longer issued. They were replaced by a register, an extract from which confirms the fact of permission to work. If organizations issue an old-style paper permit, it will not be able to function legally, and criminal liability is provided for doing work with such tolerances.

It is obligatory to have at least two specialists listed in the NOSTROY register

As of July 1, 2017, each member of the SRO must have two engineers in the staff that meet the following requirements: higher technical specialized education; advanced training received no later than the previous two years; five years of work in an engineering position (the experience is counted only after receiving a diploma of higher education); ten years of general experience in construction; no outstanding conviction. Compliance with the requirements must be confirmed by the fact that they are included in single register NOSTROY specialists. If an SRO is ready to accept an organization without specialists, it cannot be called reliable. Any verification by NOSTROY will reveal this violation and may deprive the SRO of the license.
