The ministry discussed ways to solve the problem housing, including the provision of social benefits and subsidies for the purchase of housing, compensation for hiring (sublease) for military personnel, FPS employees, rescuers and federal state civil servants of the Russian Emergencies Ministry in 2015-2016.

To whom and what is due?

According to the current legislation, the EMERCOM of Russia provides official and permanent housing for servicemen of rescue military units, FPS employees, rescuers and federal state civil servants who are registered as in need of improvement living conditions. To do this, either new houses are built, or residential premises are purchased, and social payments are made on state housing certificates within the framework of the Federal target program"Housing" for 2011-2015. In addition, the accumulative-mortgage system of housing provision for military personnel is used, lump-sum social payments and subsidies are provided for the acquisition or construction of residential premises, monetary compensations are paid for the rental (sub-rental) of residential premises.

As of May 1, 2015, 9,064 families are registered as needing housing. Including military personnel 634 families, of which those in need of housing for permanent residence- 205 families, in service housing - 429; employees of the federal fire service - 7902 families, of which 2,741 families need housing for permanent residence, 5,161 families need service housing; rescuers - 304 families.

In 2014, 2188 families of all categories of employees of the Ministry of Emergency Situations of Russia found housing, of which 742 families of military personnel, 1324 - employees of the FPS, 122 - rescuers.

The new housing order

At present, the order of housing provision of the Ministry of Emergency Situations of Russia has changed. The functions of providing housing have now been transferred to territorial bodies and units of central subordination, where the following housing commissions are formed: housing commission of the central office, housing commissions regional centers, main departments of the Ministry of Emergency Situations of Russia by subjects, educational organizations higher education Ministry of Emergency Situations of Russia, institutions and organizations of the Ministry of Emergency Situations of central subordination, as well as the housing commission Special Administration Federal Fire Service No. 3 of the Ministry of Emergency Situations of Russia of central subordination.

These structures will keep records of employees in need of housing. It organizes the registration of all categories of employees of the Ministry of Emergency Situations in need of housing, carries out the execution and issuance of state housing certificates, conducts work on the functioning of the accumulative mortgage system for housing provision for military personnel, is responsible for the entire range of measures (preparation of the work of commissions, preparation of protocols, orders, calculation of the amount of subsidies, methodological assistance territorial bodies) for the provision of lump-sum social payments for the purchase and construction of residential premises to employees of the FPS, a lump-sum cash payment for the acquisition of residential premises for military personnel, prepares orders for payment monetary compensation employees of the central office for hiring (sublease), accounting for and monitoring the movement of the housing stock of the EMERCOM of Russia.

Main problems

Today there are a number of problematic issues. The main ones - providing military personnel and employees of the FPS with permanent and service housing, providing lump-sum social payments (subsidies) for the purchase or construction of residential premises. The difficulty is that federal law on the federal budget for 2015 and the planning period of 2016-2017. budget allocations for these purposes EMERCOM of Russia is not provided.

For comparison: in 2014, 4.051 billion rubles were allocated to finance the provision of housing, in 2015 this amount amounted to only 227 million rubles.

The problem is that the amount of monetary compensation for rent (sublease) today is much lower than the market value of renting residential premises in the constituent entities of the Russian Federation.

At present, the federal executive authorities are coordinating a draft resolution of the Government of the Russian Federation on increasing payments to servicemen for hiring (subleasing) residential premises.

Problems with new buildings. So, in accordance with the Decree of the Government of the Russian Federation of June 10, 2011 No. 460 “On the marginal cost of 1 sq. meters of the total area of ​​residential premises during their acquisition (construction) for federal state needs "the cost of 1 sq. meters of the total living area in 2015 is 36,469 rubles, and the average market value 1 sq. meters of the total area of ​​residential premises in million-plus cities today is more than 100,000 rubles. per square meter. Service housing stock

According to the data provided by the balance holders, 283 people have been identified who have lost contact with the Russian Emergencies Ministry and live in official residential premises. As of April 24, 152 people have been evicted, and claims for eviction have been sent to the court against 40. In relation to 15 people, the court refused to evict, 22 citizens were sent notices of eviction.

Housing cooperatives

To provide housing for employees, work was organized to create housing construction cooperatives in the system of the Russian Emergencies Ministry. Order No. 123 of March 19, 2015 of the Ministry of Emergency Situations of Russia approved the Rules for the formation in the system of the Ministry of Emergency Situations of Russia of lists of citizens eligible to be accepted as members of housing construction cooperatives. Currently, work is underway to select land plots for transfer to gratuitous use by cooperatives.

The development of cooperatives in the EMERCOM of Russia system, as expected by the Department of Capital Construction and Operation of Fixed Assets, will reduce social tension among employees of the EMERCOM of Russia and partially solve housing issues.

Russian legislation provides for a one-time social payment to employees of the Ministry of Emergency Situations. This is more than the standard financial allowance received by employees of the department. This payment is a material support for employees of the Ministry of Emergency Situations. This assistance is targeted.

This type of payment is assigned to employees of the Ministry of Emergency Situations with one main goal - the purchase of a home by them. To receive the payment, the employee must prove his status as needing new housing. If the employee does not provide the necessary documents, the state refuses to provide him Money.

The funds received by the employee of the department can be used by him to improve his living space. But at the same time, an important condition must be observed: if the employee’s housing does not meet established requirements and norms.

The lump-sum social payment in the Ministry of Emergency Situations is paid by means of the all-Russian budget. Regional budgets are not involved in the provision of this type of compensation. For this reason, the country has a single priority for receiving such a payment.

The issue of appointment or refusal of payments is dealt with by collegiate commissions specially created on the basis of the department.

Commission work

On November 15, 2013, Directive No. 43–4927 was issued, on the basis of which commissions were created to calculate lump sum payments to employees of the Ministry of Emergency Situations. Their duties include receiving documentation from department employees. Also, the commissions are put on record and in the queue of all employees of the Ministry of Emergency Situations who have submitted documents for compensation.

There are several types of commission data:

  • departments operating on the basis of the main department and accepting documents from employees of the Ministry of Emergency Situations of the city of Moscow;
  • functioning on the basis of regional centers;
  • working in the main departments of the regions of the country;
  • accepting documents based on educational institutions Ministry of Emergency Situations;
  • operating in the central government.

Employees of the regional centers of the Ministry of Emergency Situations, subordinate to the main department of the department, have the opportunity to submit documents to the collegiate commission, which was created on the basis of the regional center.

All commissions function permanently. Their work will continue as long as there is a one-time social payment in the Ministry of Emergency Situations.

Special requirements apply to members of the commissions. They include persons whose activities do not create conflicts. Collegial commissions are formed on an open basis. This reduces the likelihood conflict situations between applicants and committee members.

ERUs for employees of the Ministry of Emergency Situations is a target financial assistance aimed at the acquisition or construction of new housing by them. To accept documents from employees of the Ministry of Emergency Situations, put them on record and resolve the issue of assigning payments on the basis of the regional centers of the department, collegiate commissions are created.

Other powers of commissions

The principle of operation and the main powers of the commissions for processing social payments are contained in the procedure developed on the basis of the Order of the Ministry of Emergency Situations No. 6 dated January 14, 2015.

The full set of powers of the commissions includes:

  • adoption of a positive or negative decision on the application of an employee of the Ministry of Emergency Situations applying for payment;
  • verification of the employee for his compliance with all conditions for the accrual of funds;
  • resolving the issue of deregistration of employees;
  • consideration of all received applications and documents attached to them;
  • registration of applications in special journals;
  • issuance of certificates of acceptance of documentation from employees;
  • keeping records of all applicants;
  • holding meetings;
  • maintaining protocols for them;
  • entering information about employees into the Housing EMERCOM of Russia database;
  • sending extracts from the minutes of commission meetings held to employees;
  • sending extracts from orders for the transfer of payments to employees within a month;
  • annual clarification of information on all employees applying for social benefits (no later than February 1).

The voting principle is used to make decisions by the commission. Under him, everyone is guided by the principle of majority vote. Commission meetings are convened at least once every 3 months. At least 4 meetings must be held per year.

Conditions under which an ERU is obtained

This type of cash assistance is targeted and for this reason implies a number of conditions. The main one is that an EMERCOM employee has 10 years of work experience. This experience includes:

  • vacation periods;
  • periods of incapacity for work due to illness;
  • vacations during which the employee cared for the child.

It is important that the employee works all the time in units subordinate to the main department of the Ministry of Emergency Situations. If he worked in other departments and at least once received any type of compensation or payment, then he loses the right to a one-time social payment through the Ministry of Emergency Situations.

On the this species monetary compensation can be calculated not only by the current employees of the department, but also by those who have retired on a seniority basis. The same rules apply to them, and the payment is made on the same grounds and conditions.

In addition to the length of service, another condition is provided - the employee needs housing. Not everyone can be recognized as needing it. These include the following categories:

  • living in hostels;
  • do not have housing in personal property;
  • living with a sick family member suffering from a serious illness;
  • living in a communal apartment;
  • living in a 1-room apartment together with its owners who are not family members;
  • living in an apartment not under a social lease agreement;
  • living in a non-insulated room along with its owners who are not family members;
  • living in their own apartment or renting housing under a social lease agreement, the area of ​​\u200b\u200bwhich for each family member is less than 15 m 2;
  • living in emergency housing.

At the same time, not only the employees of the department, but also their families, should need housing. Moreover, the list of relatives includes the following persons:

  • wives, husbands with whom an official marriage is registered;
  • disabled dependents;
  • children under 18;
  • disabled children up to 23 years of age;
  • widowers, widows who lived before the death of the worker with him in marriage;
  • employee's parents.

Often, the assignment of a lump-sum social payment to an employee of the Ministry of Emergency Situations is refused due to the availability of housing from his parents. This decision commission can be challenged in court.

To receive ERUs, employees of the Ministry of Emergency Situations must meet two main conditions: they must have 10 years of work experience in the department and objectively need housing.

Required documentation for registration

  • passport along with its copy;
  • copy of SNILS;
  • excerpts from house books, financial accounts of an employee for a 5-year period;
  • a copy of the social loan agreement, if the employee, together with his family, rents a living space on it;
  • application form;
  • excerpt from unified registry real estate for the applying employee and his family;
  • a copy of the supporting document confirming the applicant's right to a larger living space;
  • copies of passports of the applicant's family members or their birth certificates;
  • the employee's marriage certificate or divorce document;
  • certificates from schools, colleges, universities for children from 18 to 23 years old living with the applicant in the same dwelling;
  • copies of certificates indicating the location or residence of the applicant together with his family;
  • track record of the employee from his place of work in the form of a certified copy;
  • work book of the employee;
  • information about the insurance certificate;
  • medical certificates, if there are disabled people in the family of an employee of the Ministry of Emergency Situations;
  • documents confirming that the employee has dependents.

Commissions strictly approach the issue of filing documents. Employees are encouraged to submit documentation in a single package. The commission may request additional documentation, and the employee must complete the missing documents.

Copies of documents must be notarized. All certified documentation is provided by the employee independently.

Not in all cases, the employee has the opportunity to present certain requested documents to the commission. In such a situation, the employee must replace them with certificates confirming the impossibility of providing basic documents, indicating the reasons.

An employee of the Ministry of Emergency Situations sends certified copies of documents to the commission for processing a lump-sum social payment, the list of which is contained in guidelines departments. Documentation that the employee cannot provide to the commission is replaced by other supporting documents.

Some features of payment processing

A one-time social payment in the Ministry of Emergency Situations has some design and purpose features. Among these features stand out:

  • the one-time nature of such compensation;
  • registration of only one employee, if the family has several employees of the department;
  • receiving payments in order of priority;
  • the availability of a priority opportunity for calculating the payment under one condition.

This type of social payment is accrued to employees of the Ministry of Emergency Situations once. There are times when both members of the family work in the department. But they can only pay for one person.

Departmental employees registered by the decision of the commission are listed in the general database. Each employee waits in line to receive ERUs. But this rule has one exception. An employee can receive social benefits out of turn. To do this, he must be a father or mother of many children. If his family has three or more children, then he receives a preferential right in comparison with his colleagues to receive funds for the purchase or construction of housing. In other cases, social benefits are calculated only in order of priority.

Departmental employees have the right to challenge the decisions of the commissions to prohibit the transfer of this payment to them. Often the commission refuses employees due to the availability of living space from their parents and adult children.

Employees have the right to go to court in this dispute. The decision of the commission will always be recognized as illegal if the employee proves that his parents and adult children live separately from him. This is due to the fact that housing legislation clearly defines the circle of family members. They are citizens living together with the applicant. The applicant himself and members of his family living with him apply for a one-time social payment.

The one-time social payment is due to employees of the Ministry of Emergency Situations one-time, they receive it in order of priority and is paid only to one family member working in the department. Only departmental workers with many children can count on extraordinary compensation.

The amount and terms of registration of social benefits

The structure of this social benefit includes:

  • housing standard;
  • the price of 1 m 2 of housing on the market in a particular region;
  • correction factor.

The price of 1 m 2 of housing when assigning a lump sum payment is taken based on official data for the region. They often differ from the real conditions of the housing market. For this reason, social benefits are not always able to cover all the expenses of an employee of the Ministry of Emergency Situations for the purchase of housing. To reduce costs when calculating the amount of compensation, correction factors are applied. But they are not always able to cover all the costs of a citizen when buying a home.

The housing standards applied when calculating the cash payment remain unchanged from the beginning of its introduction for employees of the department. The size of the housing area due to the applicant depends on the number of members of his family.

When determining the amount due to the employee, his current residence is taken into account. Those who live in houses that have an unsatisfactory condition can count on certain monetary privileges.

Bonuses to the basic payment rely on employees who have a long work experience in the department. They can count on the application of a correction factor when calculating social benefits, which allows them to compensate for about 70% of all the costs of buying a home. Privileges also rely on employees with high service ranks.

A one-time social payment to the Ministry of Emergency Situations is paid in total within 4 months from the moment when the employee applied to the commission with an application and a package of documents. Three months are given to the commission to consider the issue of granting or refusing social benefits. Another month is spent on the transfer of funds. The terms begin to be calculated from the date the commission receives the full package of documents from the employee.

A one-time social payment to employees of the Ministry of Emergency Situations is paid taking into account the standard of living space, the price of 1 m 2, and the correction factor. The decision on its payment is made within 3 months, and the payment itself is made within a month from the moment a positive decision is made.

Registration procedure

An employee of the department who meets all the conditions for receiving funds intended for the purchase or construction of housing draws up a social payment as follows:

  1. prepares necessary documentation and writes an application to the commission.
  2. Submits a package of documents to the commission.
  3. Expecting a decision within one quarter.
  4. Requests an extract from the quarterly meeting of the commission to resolve the issue of assigning social benefits to him.
  5. Receives funds within 30 days from the date when the commission made a positive decision on his application.

A similar procedure applies to departmental workers in whose family there are 3 or more children. At the same time, they can receive a one-time social payment from the Ministry of Emergency Situations in a shorter time, since an extraordinary procedure for its calculation is provided for them.

The problem is that the commission can remove any employee from the register in order to receive payment under a number of circumstances. One of them is the improvement of the employee's living conditions, which occurred in the process of considering the issue of assigning social benefits to him. In such a case, the employee will automatically lose the status of needy, and his candidacy will not be considered at subsequent meetings of the commission.

Difficulties encountered in obtaining

This type of payment has a number of problems in practice. Among the main difficulties associated with obtaining it, there are:

  • lack of funding;
  • slow progress in queues to receive it.

Both problems are interrelated. Social payments are financed from the federal budget, but despite this, problems arise from time to time with the allocation of funds.

The budget related to financing the ministry was increased 4 times in 2017, but there is still a shortage of funds for all employees applying for a one-time social payment. It is assumed that the period of promised payments for all employees will be at least 5 years. Some sources point to the full payment of money to all needy employees of the Ministry of Emergency Situations no earlier than 2026.

The second problem is the long queues. As of 2017, at least 7 thousand people apply for this type of payment. The existence of the principle of its priority assignment to employees of the emergency department with many children slows down the process of registration of compensation.

In order to speed up the procedure for issuing social benefits, workers with many children stand in a separate queue. But even in this case, it takes time to receive money.

Workers who urgently need to be relocated from emergency housing, but due to long queues for receiving social benefits, cannot do this, are temporarily accommodated with their families in departmental apartments. These apartments are often part of the housing stock formed from former fire stations.

Often the commissions make controversial and illegal decisions to refuse payments to employees, which once again leads to a delay in resolving the issue. At the same time, employees are forced to endure legal and time costs to restore their right to social benefits.

Output

A one-time social payment to employees of the Ministry of Emergency Situations is designed to smooth out the housing problem they have. Plus social benefits in its one-time nature. The employee immediately receives funds to his account, with which he has the opportunity to cover 70% of his costs for the purchase of a new living space.

This type of support has serious disadvantages. One of them is insufficient funding. There are not always sufficient funds in the federal budget, which is why the process of processing the due payments is delayed for 5-10 years.

A significant drawback of this one-time allowance is the use of the next procedure for its receipt. For this reason, more than 7 thousand employees of the department have been waiting for a long time to receive funds to improve housing.

The procedure for accounting in the EMERCOM of Russia system of employees of the federal fire service of the State Fire Service (FPS GPS) who need residential premises, as well as the rules for providing them and their family members with these premises, has been determined. The composition of the commission is formed in such a way that there are no conflicts of interest between applicants and members of the commission. In this case, the decision is always made reasonably and fairly.

Terms of receipt

Like any other targeted financial assistance, ERUs have a number of conditions for obtaining.


Thus, the main requirement is work experience in the Ministry of Emergency Situations, which cannot be less than 10 years. The length of service is calculated in calendar form. At the same time, it includes a period of temporary disability associated with parental leave, annual paid holidays, and other periods credited during the period of work and paid by the department.

If an employee received a similar payment while employed by another government department, then the right to receive ERUs is lost.

Employees retired on the basis of seniority are eligible for registration on an equal footing with existing employees of the Ministry.

Those in need of housing

Another prerequisite is the recognition of the needy in residential premises.

Those in need are the following workers Ministry of Emergency Situations:

  • does not own a dwelling;
  • who is not a tenant of residential premises under a social tenancy agreement;
  • lives in a communal apartment;
  • lives in a hostel;
  • is the owner or tenant under a social lease agreement of a dwelling where each family member has an area of ​​​​less than 15 square meters;
  • lives in a dwelling that does not comply with the rules and regulations, regardless of the area of ​​this premises;
  • lives in a one-room apartment with non-family owners;
  • lives in a non-isolated room in an apartment with other owners who are not family members;
  • lives in an apartment or house with a seriously ill family member (should be understood as a chronic form of a serious illness), which makes living impossible.
Not only an employee of the Ministry of Emergency Situations should not own an apartment or house, but also members of his family. They should be understood as spouse, parents and children. At the same time, the refusal to enroll in the queue for ERUs due to the fact that the parents of the employee of the Ministry of Emergency Situations have property can be challenged in court.

Arbitrage practice

The Commission may refuse to register an employee of the Ministry due to the fact that adult children or parents own a dwelling.

As practice shows, such a decision can be challenged in court, since the employee himself, and not his whole family, claims for housing (meaning the family, as the concept of the Family Code of the Russian Federation). If parents or adult children live separately from the applicant, the commission is not entitled to make a decision to refuse registration.

According to regulations Housing Code family members of an employee means only those family members who live with him.

Required documents

There is a set list of documents that must be submitted to the commission for subsequent registration. It is regulated by methodological recommendations.

TO necessary documents relate:

  • application in the prescribed form;
  • identity document of the applicant and its copy;
  • documents proving the identity of all members of the applicant's family, and their copies;
  • certificates of registration at the place of stay or residence of all members of the applicant's family and the applicant himself (copies);
  • a copy of the applicant's SNILS;
  • a certified copy of the applicant's service record from the actual place of work;
  • a copy of the applicant's marriage/divorce certificate;
  • certificates from educational institutions for children aged 18-23 years, provided that they live with the applicant together;
  • extracts from the United state register accounting real estate on the applicant and all family members;
  • extracts from the house books and financial accounts of the applicant and all members of his family for the last 5 years;
  • a copy of the document that confirms the applicant's right to an increased area (the presence of a certain rank);
  • a copy of the social tenancy agreement, if the applicant or members of his family live under such an agreement in a residential building.
All documents are submitted in a single list for consideration by the commission. An employee of the Ministry of Emergency Situations is obliged to provide copies on his own, as well as timely provide the missing documents at the request of the commission.

If some documents cannot be provided, the applicant is obliged to provide documents confirming the impossibility.

For example, if it is not possible to obtain extracts from house books for the last 5 years, then it is required to replace them with a document indicating that it was not possible to obtain extracts.

Timing

The application and documentation are considered by the commission within three calendar months from the date of submission by the applicant.

Regardless of what decision was made, the employee of the Ministry of Emergency Situations is obliged to receive it within a month from the date of issue.

Nuances and subtleties

If the applicants are spouses or family members living together, then the application is accepted from only one family member. And correspondingly, registration is carried out only for one applicant, as well as the lump-sum social payment itself.

If the commission makes a decision on registration, then the applicant is included in the general queue, entering data into a single database. ERUs are received on a first-come, first-served basis. If an employee of the Ministry of Emergency Situations, who is registered, has 3 or more minor children, then he gets out of turn.

That is, it has a priority right to receive payment in comparison with other employees.

Payout amount

The amount of the final social payment depends on several factors:

  • market value per square meter in the selected region;
  • housing standard;
  • correction factor.


So, standards are approved and not subject to change. If the applicant lives alone, is not married, has no children or dependents, then he is entitled to no more than 33 square meters of area. If the applicant's family consists of two family members, including himself, then the standard increases to 42 square meters. If the family consists of three or more people - 18 square meters per person.

The cost of one square meter in the area taken into account only on the basis of approved data, which in fact may differ from the real market conditions. Therefore, sometimes a one-time social payment does not cover all the costs of acquiring housing, even taking into account the adjustment factors.

Problems of obtaining ERUs

Despite the fact that the right to receive a lump sum payment is enshrined at the federal level, in fact there is not enough funding to pay the funds to applicants on time.

Therefore, the queue for ERUs is moving rather slowly.

The Minister of Emergency Situations Vladimir Puchkov said that in 2017 the budget for payments will be increased by 4 times, but the special speed for advancing the queue for financial assistance will not increase.

At the end of 2016, a plan was drawn up, according to which all payments should be made within 5-10 years, not earlier. At the same time, the priority right will remain with employees with many children who are registered. According to the Ministry, more than 7,000 people are already on the waiting list, who are temporarily provided with departmental housing from the housing stock of converted and redesigned fire stations.
