Model industry standards for the issuance of workwear and PPE

Model industry issuance norms special clothing are approved by individual orders of the Ministry of Health and Social Development of the Russian Federation. The main content of industry standards are tables of specialties, which establish in detail what kind of overalls and protective equipment should be provided to employees of each specialty. The norms for the free issuance of PPE to employees for 2016 were established by the Order of the Ministry of Labor of the Russian Federation No. 997n dated December 9, 2014. What documents regulate the norms for the free issuance of PPE to employees

Order of the Ministry of Labor and social protection RF dated December 9, 2014 No. 997n “On Approval of the Model Norms for the Free Issue of Special Clothing, Special Footwear and Other Personal Protective Equipment to Employees of Cross-cutting Professions and Positions of All Types economic activity employed in work with harmful and (or) dangerous working conditions, as well as in work performed in special temperature conditions or associated with pollution. This Order entered into force three months after its official publication.

With the entry into force of Order No. 997n, the Standard Norms for the free issuance of PPE in 2016, special clothing, special footwear and other personal protective equipment to workers in cross-cutting professions and positions of all types of economic activity, employed in work with harmful and (or) dangerous working conditions, come into force , as well as in work performed in special temperature conditions or associated with pollution, according to the appendix.

What standard norms for the free issuance of PPE in 2016 should employers comply with

Labor legislation provides that it is the responsibility of the employer to ensure safe conditions and labor protection for employees. According to Art. Art. 212 and 221 of the Labor Code of the Russian Federation, the obligation of the employer is to acquire and issue at the expense of own funds employees who are employed in work with harmful or dangerous working conditions, as well as in work performed in special temperature conditions or associated with pollution, special clothing, footwear and other personal protective equipment (hereinafter referred to as PPE) in accordance with established standards in the manner, determined by the Government of the Russian Federation.

Intersectoral rules for providing workers with PPE, special clothing, special footwear and other personal protective equipment (hereinafter referred to as the Rules), approved by Order No. 290n of the Ministry of Health and Social Development of the Russian Federation of 06/01/2009.

Intersectoral rules for the provision of PPE in 2016 regulate mandatory requirements to the acquisition, issuance, use, storage and care of special clothing, special footwear and other personal protective equipment.

Personal Protective Equipment (PPE) is a means of individual use, the use of which helps to prevent or reduce the impact on workers of harmful and (or) hazardous production factors, and also protects against pollution. These means include overalls, safety shoes, as well as insulating suits, respiratory protection, hands, head, face, eyes, hearing organs, various safety devices, etc.

Obligations of the employer to ensure the norm for the issuance of PPE in 2015

It is the responsibility of the employer to provide PPE to its employees free of charge if they work in jobs with harmful and (or) dangerous working conditions, as well as if the work is performed in special temperature conditions or associated with pollution. This provision is enshrined in Art. Articles 212 and 221 of the Labor Code of the Russian Federation. Employees must be provided with these means, in accordance with model rules issuance of PPE, in the prescribed manner, determined by the Government of the Russian Federation. The list of occupations of workers that are subject to the norms for providing PPE has been formed by the relevant resolutions of the Ministry of Health and Social Development and the Ministry of Labor of Russia.

So, for workers of cross-cutting professions and positions of all sectors of the economy, employed in work with harmful and (or) dangerous working conditions, as well as those performed in special temperature conditions associated with pollution, the Standard norms for the free issuance of certified overalls and safety shoes and other PPE are approved by the Order of the Ministry of Health and Social Development Russia dated 01.10.2008 No. 541n.

For workers of which professions, industry standards for the issuance of PPE are provided

The norms for the free issuance of PPE, as well as warm overalls and warm safety shoes for climatic zones, are the same for all industries, approved by the Decree of the Ministry of Labor of Russia dated December 31, 1997 No. 70.

This Order establishes the list and norms for the issuance of PPE for the year of special clothing, special footwear and other personal protective equipment for employees various professions and positions employed in work with harmful or dangerous working conditions, as well as in work performed in special temperature conditions or associated with pollution. The names of the professions of workers and positions of specialists and employees provided for in the Model Regulations are indicated in accordance with:

  • with the Unified Tariff and Qualification Directory of Works and Professions of Workers (at the same time, the ETKS is divided into issues by type of economic activity);
  • With Qualification guide professions of workers who are set monthly salaries;
  • with the Qualification directory of positions of managers, specialists and employees.

Typical and industry norms for issuing PPE in 2016

There are standard and industry norms for issuing PPE. Standard norms for the issuance of PPE are intended for workers in cross-cutting professions and positions in all sectors of the economy. For example, at any enterprise, regardless of its industry affiliation, a watchman, cleaners, couriers and loaders work. But there are also specific professions that are characteristic only for a certain type of production. For example, the profession of a driver-collector in a bank or a gas cleaning operator at chemical production, seamstress in the organization of consumer services. For them, industry standards for the issuance of PPE have been adopted.

The procedure and norms for providing workers with PPE are established by the Rules for providing workers with special clothing, special footwear and other personal protective equipment (hereinafter referred to as the Rules). Paragraph 3 of the Rules stipulates that employees whose professions and positions are provided for in the Model Norms for the free issuance of special clothing, special footwear and other personal protective equipment to employees of cross-cutting professions and positions in all sectors of the economy, personal protective equipment is issued regardless of in which industries, they work in workshops and at sites, unless these professions and positions specifically provide for the relevant standard industry standards for the issuance of PPE.

If we take, for example, a battery worker who works at a motor transport enterprise, PPE is issued in accordance with Order No. 541n, and if an employee with such a profession works in the mining industry, then he is required to provide PPE in accordance with the Standard Industry Standards for the free issue of PPE for special clothing, special shoes and other personal protective equipment for workers in the mining and metallurgical industries and metallurgical industries in other industries. Is it possible to establish individual norms for the issuance of PPE in the organization in 2016

In part 2 of Art. 221 of the Labor Code of the Russian Federation, it is prescribed that the employer is authorized, taking into account the opinion of the trade union body of the enterprise or other representative body of employees and the availability of financial opportunities, to establish standards for the free issue of PPE, special clothing, special footwear to employees, which improve, compared with the Standard standards for the issuance of PPE, the protection of workers from harmful and (or) dangerous factors, as well as special temperature conditions or pollution. Thus, according to clause 6 of the Rules, the employer has the right to provide its employees with certain types of PPE (goggles, respirators, gas masks) not listed in the Standards, based on the results of a special assessment of working conditions.

Previously, when attesting workplaces, the provision of workers with personal protective equipment was assessed. However federal law"O special evaluation working conditions” is not provided. Instead, the effectiveness of the applied PPE will be evaluated. The methodology for evaluating the effectiveness of PPE has been developed by the Russian Ministry of Labor, but has not yet been registered with the Russian Ministry of Justice. The novelty lies in the fact that, based on the results of assessing the effectiveness of PPE, it is possible to reduce the class or subclass of hazardous working conditions.

Important!

Standard industry norms for the free issuance of PPE to employees are mandatory for the employer and cannot be reduced.

Norms for providing workers with PPE: the obligations of the employer

It is the responsibility of the employer to ensure and timely issue PPE to employees in accordance with established standards (part 3 of article 221 of the Labor Code of the Russian Federation). Protective equipment issued to employees must correspond to their gender, height and size, the nature and conditions of the work performed and ensure labor safety (clause 8 of the Rules).

The duty of the employer is to inform employees about the personal protective equipment they are entitled to (part 2 of article 212 of the Labor Code of the Russian Federation), each employee must be familiar with the rules and norms for issuing PPE when concluding with him employment contract(clause 7 of the Rules).

After the employer has established for which professions of workers, in what quantity and for what period they should be issued PPE, this should be recorded in the internal documents of the enterprise. As a rule, a separate document is drawn up for the organization, which defines the rules and norms for issuing PPE in 2016. It also prescribes the procedure for issuing, using, storing and maintaining PPE in proper condition, and opposite each profession (position), a list is provided indicating the terms of use or issuance rates per year. The standards established by this document should not worsen the provision of workers with protective equipment, in comparison with the Standard Norms for the Issuance of PPE. An extended list can also be provided if the employer has the financial capacity and is ready to spend money on purchasing excess PPE.

Rules and norms for the issuance of PPE can be established by the annex to collective agreement or an independent local act.

Today we will get acquainted with the provisions for issuing workwear to workers involved in various industries. Consider the rules and regulations of 2016.

Who sets the norms for issuing special clothing at enterprises?

The right to receive a uniform was assigned to workers by order of the Ministry of Labor of the Russian Federation two years ago, in December 2014. Protective equipment is required for a number of professions (about 195 positions). As a rule, this applies to:

  • hazardous and hazardous industries;
  • companies whose employees are involved in security;
  • employees in the field of medicine and pharmacology, etc.

But it is not limited to them. In such enterprises, standard norms often apply. The management has the right to independently establish others, if they do not contradict the current ones and do not infringe on the rights of employees. In other words, if the director thinks he can improve employee protection, he is free to do so. In the latter case, own order issuance of a uniform must be entered in the relevant internal documents of the company. Alternatively, it is possible to write this item in a single document, which then needs to be familiarized with each staff unit. Such documents can be, for example:

  • collective labor contract;
  • Order;
  • Position.

And, of course, the mandatory issuance of work clothes should be free. Management is not entitled to withhold its value from the income of subordinates. For violation of the norms for the issuance of overalls, the enterprise faces a fine of 20 to 150 thousand rubles. The biggest fines are legal entities for non-issuance of protective equipment that protect the body of the employee from factors that cause serious harm to health. These include, for example, protective masks and goggles for welders, footwear that protects against punctures and cuts, fireproof overalls, etc.

List of professions that are required to issue special clothing

The list today consists of 195 professions. Therefore, we will not present it here in full. Compared to previous years, it has doubled. You can get acquainted with it by reading Order No. 997 of the Ministry of Labor dated 09.14.

Advice. If in past years, the issuance of workwear was not provided for employees of your company, then it is worth checking. Perhaps now these lists of professions are on the list.

How many sets of clothes can I get?

Each employee can receive one norm of clothing. Since December 2014, it is allowed to receive a double rate immediately. For example, if an employee is entitled to 2 protective suits per year and 5 pairs of gloves, then the organization has the right to immediately give him 4 suits and 10 pairs of gloves for 2 years. Legislators explained this innovation by the fact that such an order will allow workers to be more tidy, and clothes will wear out less quickly.

Also, among the innovations, it can be noted that now it is possible to issue protective overalls to workers who combine several professions. For example, if a person in production is listed as a battery worker and as a driver at the same time, then now he will receive both sets of special clothing. One for the driver and one for the battery operator. For employers, these are very important innovations, as they allow them not to have problems with the tax authorities in connection with exceeding the norms and overspending on the purchase of uniforms.

All clothes, uniforms, protective equipment issued to the employee are transferred to him for use, but continue to be the property of the company. The exit of an employee to work without the use of these is not allowed and is classified as a violation labor discipline. The employer, for the appearance of an employee at work in an improper form, risks receiving a fine from the inspection organization.

Workwear Care

Care of overalls at work must be provided by the employer. This means that a firefighter or a crane operator, or a cashier, or a salesman is not required to carry his overalls or apron home for further washing or ironing. The employer himself is obliged to provide for the possibility of cleaning the products and bringing them to their original form, either by their own efforts or by concluding contracts for the provision of relevant services with contractors.

Rules for the use of overalls. briefing

The employer is obliged to convey to each employee how to properly use the uniform, overalls, protective equipment in order to prevent their damage and premature wear. This is done in the form of special briefings and the issuance of printed instructions.

In the spring and summer, workers should be provided with repellents, ticks and insects, including blood-sucking ones. And this applies to all positions. Even if the employee does not leave the closed premises and is an employee of a store or office. Any types of protective equipment and overalls are issued to employees in accordance with and taking into account their seasonality.

Certification of protective equipment and overalls

In accordance with Article 212 Labor Code Russian Federation, all overalls and protective equipment must be certified and comply with GOST. Goods manufactured abroad and having certificates of foreign production must also go through the procedure for recognizing their conformity in the territory of our country. The employer is responsible for the presence or absence of documents confirming the existence of a certificate of conformity for the purchased funds. In addition, he is obliged to check each batch of purchased workwear before issuing it to employees. By creating for this a commission of at least 3 people and recording the results of the audit.

Employee Responsibility

Since any protective equipment, uniforms, workwear issued to employees is the property of the company, in case of damage or loss, the employee will have to reimburse the company for the costs incurred. Of course, only if the incident occurred due to the fault of the employee, his negligence, and not due to the specifics and working conditions.

Norms for issuing workwear by profession

The norms for the free distribution of overalls, established in 2008, were changed in 2014. The number of requirements for different professions has grown to 195 guidelines. The determined rate of issue of overalls and safety shoes depends on the working conditions of a person, the features of wear of sets and auxiliary items. According to now current order(Norms for issuing workwear 997n) workers in the following areas of activity should receive free overalls, boots, gloves and other work uniforms:

  • chemical, metallurgical, woodworking industry;
  • workshops and factories engaged in the production of automobiles, military equipment;
  • aviation and space industry;
  • agriculture, fisheries and forestry;
  • construction, transport sector;
  • medicine, pharmacology, scientific laboratories.

A separate category included overalls for trade workers, financial industry. It is mandatory to provide PPE to employees of enterprises involved in security.

Order for the issuance of overalls to employees

Carrying out the issuance and its documentary confirmation should be carried out at all enterprises falling under the state classification. The transfer of PPE is carried out in accordance with by special order signed by the head. Usually, the period for which the overalls are enough is 1 year. But it is also envisaged to transfer a double norm to an employee (standard norms for issuing workwear order 290n) for 2 years. This will allow the employee to carry out cleaning and repair of products in time, to exclude the rapid wear of things.

Approval of the norms for the issuance of overalls is carried out according to a separately issued order. It contains data on the transferred PPE for each individual employee according to his profession. The state order is also indicated, which determines the norm of overalls for the year. Lack of such documentation at the enterprise may result in an administrative fine.

Norms for issuing workwear to employees in 2016

In 2016, the norms for issuing workwear 2015, the order dated December 9, 2014, continue to apply. Therefore, when compiling new documentation (after the expiration of the year of use of the issued clothing), managers can only change the date and immediately issue a new order document. The content remains the same if the working conditions of workers, their professions, duties have not changed.

The adopted new norms for the issuance of overalls cover not only specialized areas of activity (mining, laboratory research). They also include work in specialized professions: drivers, bank employees, employees of organizations involved in the control of technical equipment of companies, factories, private or state enterprises.

Industry norms for issuing workwear

The accepted norms for the free distribution of overalls and PPE predetermine both the quality of products and their characteristics. For each field of activity, the danger and complexity of work require the use of things that are unique in quality and parameters. For example, industry requirements for the stability of workwear include protection against:

  1. Mechanical impacts (ruptures, punctures), general industrial pollution.
  2. Electromagnetic and electric fields, radioactive or X-ray radiation.
  3. Non-toxic particles and fumes.
  4. Low / high temperature conditions.
  5. Toxic substances, acids, oil products.
  6. Biological threat (bacteria, harmful and dangerous insects).

For each type of overalls there are Additional requirements: color, the presence of reflective stripes. Special attention is paid to practicality, ease of tailoring.

Issuance of overalls to drivers, builders, housing and communal services workers

According to available government requirements the number of elements issued must exactly match (or not be lower than) the specified norm. In many ways, the order and quantity of PPE is determined by working conditions. For example, builders working on sites during the construction of buildings need to be given overalls, masks, gloves, helmets. Repairers who only finishing works, gloves, masks, overalls should be issued.

Drivers carrying out cargo transportation or dangerous transportation (oil, refined petroleum products) should be given overalls made of dense fabric (summer and winter sets), leather boots, gloves with a dotted coating. Assumes the norm of issuing overalls to car drivers, the provision of products with increased wear resistance, the ability to protect against dust and dirt. Workers of housing and communal services should be given overalls, vests, leather boots, seals. A protective helmet (for managers and specialists) is issued not for 1 year, but for a period limited by the wear and tear of the product.

Issuance of overalls to medical workers

Special norms for issuing workwear medical workers determine the provision of products for protection against biological threats, X-ray exposure, harmful and hazardous mixtures. Employees of X-ray rooms are provided with a protective gown with a bib, glasses. Laboratory workers are provided with special gowns, aprons, gloves, masks. Nurses and doctors who work exclusively with patients receive gowns and masks.

The Labor Code of the Russian Federation directly instructs employers to issue free special clothing, special footwear, other personal protective equipment (hereinafter, we will collectively call PPE), as well as washing and neutralizing agents to employees who work at work:

  • with harmful or dangerous working conditions;
  • performed under special temperature conditions;
  • associated with pollution.

PPE includes suits, gowns, aprons, sleeves, goggles, face shields, filtered respiratory protection, safety devices, etc. PPE is issued in accordance with standard standards and only those that have passed mandatory certification or declaration of conformity (Articles 212, 221 of the Labor Code of the Russian Federation).

Model norms for issuing PPE

To date, the regulations of the Ministry of Health and Social Development and the Ministry of Labor have approved many standard norms for the free issuance of PPE. Most of them determine the issuance norms for workers employed in specific sectors of the economy. The employer should be guided by them in accordance with the type of activity that he conducts (clause 14 of the Intersectoral Rules, approved by Order of the Ministry of Health and Social Development of 06/01/2009 N 290n).

So, if a company is engaged, for example, in the production of electrical equipment, then it can use:

  • standard norms for employees of radio engineering and electronic productions(Appendix No. 4 to the Decree of the Ministry of Labor of December 25, 1997 N 66);
  • standard norms for workers in electrical production (Appendix No. 3 to the Decree of the Ministry of Labor of Russia of December 16, 1997 N 63).

In them, opposite each profession (position) of the employee, the names of the required PPE and the rate of their issuance, as a rule, for a year are indicated. The norm is set in pieces, pairs, the number of units, sets, etc.

If any professions (positions) are not named in industry standard norms, then the employer should be guided by standard norms for workers in cross-cutting professions and positions in all sectors of the economy (Order of the Ministry of Labor dated 09.12.2014 N 997n). Obviously, these norms list those professions and positions that are found in various fields of activity.

For example, the driver. If he operates a truck crane, then (regardless of the industry in which he works), in accordance with the norms, he must be given a suit for protection against general industrial pollution and mechanical impacts and 6 pairs of polymer-coated gloves for a year. A similar set is assigned, for example, to the head of the household. Only he is given not a suit to protect against pollution, but a dressing gown.

The norms for the free issue of warm special clothing and footwear to employees in climatic zones are established by others. normative act(Resolution of the Ministry of Labor of the Russian Federation of December 31, 1997 N 70). It also indicates which regions belong to which zone.
